What is LMIA ?

LMIA refers to a specific study of the labour market’s impact. This is a paper produced by the Economic and Social Development Commission (ESDC) (Employment and Social Development Canada).

The chief aim is to determine the impact of recruiting foreign nationals in Canada. If the LMIA is positive, it means that no permanent resident or Canadian citizen is available to fill the position. As a result, the employer has the option of hiring a foreign national to fill this position. A negative LMIA, on the other hand, indicates that a particular job must be filled by a permanent resident or Canadian citizen.

Can foreign nationals apply for LMIA?

Because this is something that Canadian companies must undertake, no foreign national can apply for an LMIA. The application method may differ depending on the NOC and the individual’s remuneration to be employed. Employers must determine the median hourly rate in their respective provinces in order to determine if this position is a high-wage or low-paid position.

 

Additional criteria must be completed for low-wage jobs. As a result, applications must show that they meet the following criteria:

>A CAD $1000 processing charge is non-refundable (few exemptions are offered)

>Transition strategy

>Documents of Business Legitimacy

>Evidence of recruitment efforts

>Wage information for TFWs

>Evidence of workplace safety and business behaviour

Before recruiting somebody for that post, the employer must wait for a decision to be issued. However, if the LMIA is positive, the employer can proceed with the process. Employers can also go through the Arranged Employment Offer process in a different method (AEO). It has several restrictions, yet it can be helpful for people who want to immigrate.

 

What is Arranged Employment Offer?

Arranged Employment means that you have a genuine employment offer from a Canadian employer that has been verified by the ESDC, indicating that you are eligible for the Federal Skilled Worker Program or the Federal Skilled Trades Program in Express Entry permanent immigration.

On the FSW selection grid, Arranged Employment is worth 15 points. In addition, on the CRS score, the Arranged Employment Offer is worth 50 points for NOC O, A, or B and 200 points for NOC OO. IRCC processes applicants with pre-arranged jobs within six months.

Note: Foreign workers can apply for a Work Permit to work in Canada on a temporary basis if their LMIA is positive.
